At 31 6/7 gestational weeks, an ultrasound indicated that the mother had a shortened cervical length, which put her at risk for preterm labor. After two days, exams showed signs of infection, and medical providers gave the mother steroids in order to develop the baby’s lungs in case delivery began prematurely. The mother came back to the hospital three days later showing signs of cervical/vaginal infection, and the doctors gave her urinary tract infection (UTI) antibiotics instead of the antibiotics necessary to cure cervical and vaginal infections. After three days, the mother once again returned to the hospital with leaking fluid, contractions, and a high white blood cell count. The mother was admitted to the hospital at 32 5/7 weeks with the plan to deliver if signs of chorioamnionitis appeared. Four days later (after signs of chorioamnionitis has been apparent for two days), the physician noticed fetal tachycardia and decreased heart rate vulnerability and ordered a Cesarean section operation.

Throughout the mother’s pregnancy, three separate medical professionals failed to communicate with each other regarding the mother’s hospital admissions and medical reports. As a result, the medical professionals failed to obtain the information necessary to diagnose her vaginal and cervical infection and schedule a safer, earlier delivery. After delivery, the placental examination indicated the presence of infection in the umbilical cord and placenta, proving that the infection had moved from the mother’s cervix to the placenta and umbilical cord, thereby causing fetal infection. While the baby was in the neonatal intensive care unit after delivery, brain imaging showed signs of neonatal brain damage. The baby was then diagnosed with cerebral palsy (CP), epilepsy, physical and cognitive impairments, and cortical blindness.
